THE PRESIDENT: Good morning. This week I visited with troops at Charleston Air Force Base. These fine men and women are serving courageously to protect our country against dangerous enemies. The terrorist network that struck America on September the 11th wants to strike our country again. To stop them, our military, law enforcement, and intelligence professionals need the best possible information about who the terrorists are, where they are, and what they are planning.

One of the most important ways we can gather that information is by monitoring terrorist communications. The Foreign Intelligence Surveillance Act -- also known as FISA -- provides a critical legal foundation that allows our intelligence community to collect this information while protecting the civil liberties of Americans. But this important law was written in 1978, and it addressed the technologies of that era. This law is badly out of date -- and Congress must act to modernize it.

Today we face sophisticated terrorists who use disposable cell phones and the Internet to communicate with each other, recruit operatives, and plan attacks on our country. Technologies like these were not available when FISA was passed nearly 30 years ago, and FISA has not kept up with new technological developments. As a result, our Nation is hampered in its ability to gain the vital intelligence we need to keep the American people safe. In his testimony to Congress in May, Mike McConnell, the Director of National Intelligence, put it this way: We are "significantly burdened in capturing overseas communications of foreign terrorists planning to conduct attacks inside the United States."
To fix this problem, my Administration has proposed a bill that would modernize the FISA statute. This legislation is the product of months of discussion with members of both parties in the House and the Senate -- and it includes four key reforms: First, it brings FISA up to date with the changes in communications technology that have taken place over the past three decades. Second, it seeks to restore FISA to its original focus on protecting the privacy interests of people inside the United States, so we don't have to obtain court orders to effectively collect foreign intelligence about foreign targets located in foreign locations. Third, it allows the government to work more efficiently with private-sector entities like communications providers, whose help is essential. And fourth, it will streamline administrative processes so our intelligence community can gather foreign intelligence more quickly and more effectively, while protecting civil liberties.

Our intelligence community warns that under the current statute, we are missing a significant amount of foreign intelligence that we should be collecting to protect our country. Congress needs to act immediately to pass this bill, so that our national security professionals can close intelligence gaps and provide critical warning time for our country.

As the recent National Intelligence Estimate reported, America is in a heightened threat environment. Reforming FISA will help our intelligence professionals address those threats -- and they should not have to wait any longer. Congress will soon be leaving for its August recess. I ask Republicans and Democrats to work together to pass FISA modernization now, before they leave town. Our national security depends on it.

Buenos Días. Esta semana visité a tropas en la Base de la Fuerza Aérea de Charleston. Estos excelentes hombres y mujeres están sirviendo valientemente para proteger a nuestro país contra enemigos peligrosos. La red de terroristas que atacó a Estados Unidos el 11 de Septiembre quiere volver a atacar a nuestro país. Para detenerlos nuestros profesionales militares, policiales y de inteligencia necesitan la mejor información posible sobre quienes son los terroristas, dónde se encuentran y qué es lo que están planeando.

Una de las formas más importantes en que podemos recoger esa información es monitoreando las comunicaciones de los terroristas. La Ley de Vigilancia de Inteligencia en el Extranjero – también conocida como FISA por sus siglas en inglés – ofrece una base legal crítica que permite a nuestra comunidad de inteligencia recoger esta información mientras protege las libertades civiles de los estadounidenses. Pero esta importante ley fue escrita en 1978 y enfocaba las tecnologías de aquella época. Esta ley está seriamente desactualizada – y el Congreso debe actuar para modernizarla.

Hoy en día enfrentamos a terroristas sofisticados que usan teléfonos celulares desechables así como la Internet para comunicarse entre sí… reclutar a operarios… y planear ataques contra nuestro país. Tecnologías como estas no estaban disponibles cuando FISA fue aprobada hace casi treinta años – y FISA no se ha mantenido al día con nuevos desarrollos tecnológicos. Como resultado, nuestra Nación se ve obstaculizada en su capacidad de obtener la inteligencia vital que necesitamos para mantener a salvo al pueblo estadounidense. En su testimonio al Congreso en Mayo, Mike McConnell, Director de Inteligencia Nacional, lo dijo así: Estamos, y cito, “sumamente limitados para capturar comunicaciones en otros países de terroristas extranjeros que están planeando llevar a cabo ataques dentro de Estados Unidos”.

Para corregir este problema mi Administración ha propuesto un proyecto de ley que modernizaría el estatuto de FISA. Esta legislación es el producto de meses de discusión con miembros de ambos partidos en la Cámara de Representantes y el Senado – e incluye cuatro reformas claves:

Primero, actualiza a FISA con los cambios en tecnología de comunicaciones que han ocurrido en las últimas tres décadas. Segundo, busca regresar a FISA a su enfoque original de proteger los intereses de privacidad de las personas dentro de Estados Unidos – para que no tengamos que obtener órdenes de los tribunales para efectivamente recoger inteligencia extranjera sobre objetivos extranjeros situados en localidades extranjeras. Tercero, le permite al gobierno trabajar más eficientemente con entidades del sector privado como proveedores de comunicaciones, cuya ayuda es esencial. Y cuarto, hará más eficiente los procesos administrativos de modo que nuestra comunidad de inteligencia pueda recoger inteligencia extranjera de manera más rápida y eficaz – mientras protege las libertades civiles.

Nuestra comunidad de inteligencia advierte que bajo el estatuto actual estamos perdiendo una cantidad importante de inteligencia extranjera que deberíamos estar recogiendo para proteger a nuestro país. El Congreso necesita actuar de inmediato para aprobar este proyecto de ley de modo que nuestros profesionales de seguridad nacional puedan cerrar lagunas de inteligencia y ofrecer tiempo de alerta crítico para nuestro país.

Como informó el reciente Estimado sobre Inteligencia Nacional, Estados Unidos se encuentra en un ambiente de amenaza enaltecida. Reformar a FISA ayudará a nuestros profesionales de inteligencia enfocar esas amenazas – y no deberán tener que esperar más. El Congreso pronto partirá para su receso de agosto.
